The South African government’s proposed Prevention and Combating of Hate Crimes and Hate Speech Bill will once again be open for public comment and appear before Parliament. While AfriForum supports sanctions on true hate speech, we believe this Bill distorts the meaning of the concept and constitutionally protected expression could be criminalised if the Bill is passed.

AfriForum believes that the current version of the Bill is unconstitutional and that it threatens freedom of expression because:

  1. The double standards with regards to cases of hate speech are worsening.
  2. This bill waters down the constitutional standard for hate speech to a dangerous degree.
  3. The constitutional right to freedom of expression has come under an increasing threat in recent years.
