AfriForum objects to Matlosana’s budget process
The AfriForum branch in Klerksdorp has formally objected to the Matlosana Local Municipality’s budget process for the 2026/2027–2028/2029 financial years due to the material irregularities during the process. The civil rights organisation demands that the Municipality immediately restart this process as the current public participation process is legally in breach of the Municipal Finance Management Act (MFMA) and the Municipal Systems Act.
Although a 21-day period for public participation was announced in an advertisement dated 10 April, critical documents relating to budgets and the Integrated Development Plan (IDP) were not available on the municipal website. Furthermore, they could not be obtained on request from local libraries or the office of the Speaker.
AfriForum further refers to Council Resolution CC 87/2025, item 5, paragraph (d), adopted in May 2025, which specifically instructs the Executive Mayor to provide written feedback on submissions made by the public and stakeholders during the previous budget process. According to AfriForum, this resolution was aimed at giving effect to Section 23 of the MFMA, which requires municipalities to properly consider public input and engage with stakeholders during the preparation of budgets. To date, no such written feedback has been provided.
“The Municipality has in effect compromised the community’s right to meaningful public participation. By withholding critical strategic plans and financial figures, stakeholders are prevented from conducting a thorough evaluation or making informed submissions,” says Alta Pretorius, AfriForum’s District Coordinator for the Mooi River.
AfriForum is of the opinion that the mere extension of the commentary period is insufficient to protect constitutional rights. The organisation formally demands that the current process be set aside and started anew to ensure that the 2026/2027 budget and IDP documents are lawfully tabled and made accessible to all residents.
“The continued failure to provide this written feedback is not merely an administrative oversight; it is a direct disregard for the public’s right to participate in the budget process. This lack of accountability undermines the oversight role of the council and erodes the trust of stakeholders who have made the effort to engage with the Municipality,” says S.W.
