In January 2023, Malema and the EFF applied for leave to appeal in this case at the High Court in Pretoria. The High Court dismissed their application which prompted the EFF to approach the Constitutional Court with this matter.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe implications of Malema and the EFF\u2019s intense desperation to have this land invasion judgment overturned, are troubling. Why is the EFF so determined to be able to incite lawlessness?\u201d says Ernst van Zyl, Campaign Officer for Strategy and Content at AfriForum.<\/p>\n<\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThis ruling is however yet another major win for the right to private property and a devastating loss for those who wish to incite criminality and violence. AfriForum welcomes the Constitutional Court\u2019s reaffirming of the High Court\u2019s strong judgment against the incitement of land invasions,\u201d Van Zyl
