The leader of the Economic Freedom Fighters (EFF), Julius Malema, is in court tomorrow for sentencing on five charges.

Malema was already found guilty on 10 January 2026. The charges include discharging a firearm in a built-up or public area without sufficient reason, unlawful possession of a firearm, and unlawful possession of ammunition.

  • Sentencing is scheduled.
  • The Court will rule on the applicable punishment for each violation.
  • Julius Malema is found guilty of violations of the Firearms Control Act 60 of 2000. He is found guilty on the following charges:
    • Unlawful possession of a firearm
    • Unlawful possession of ammunition
    • Discharging a firearm in a built-up area without any sufficient reason
    • Reckless endangerment to person or property (count 1)
    • Reckless endangerment to person or property (Count 2).
  • The hearing takes place and witnesses, including video material of the incident, are brought before the court.
  • AfriForum follows the proceedings carefully and remains involved in the process.
  • The National Prosecution Authority (NPA) fails to decide on prosecuting Malema.
  • AfriForum’s private prosecution unit eventually threatens with legal actions to force the NPA to decide.
  • After this pressure, the case is put on the court roll, and the legal process starts building momentum.
  • The investigation drags on with hardly any progress, while there is very little visible development.
  • AfriForum keeps monitoring the case and to apply pressure for action against Malema.
  • AfriForum intervenes and lays formal charges against Malema.
  • AfriForum also starts applying continuous pressure to ensure the case is investigated.
  • Julius Malema is filmed at the EFF’s fifth birthday celebrations in Mdantsane in the Eastern Cape, discharging a firearm in public before a crowd of supporters.
  • The incident attracts much media attention, but the SAPS refuses to act

AfriForum has published a comprehensive dossier which highlights Malema’s history of hate speech, alleged involvement in corruption, incitement to violence, and his support for terrorist groups.

The world has already started to react: Earlier this year the UK refused Malema a visa as a result of his hate speech. This is however only the beginning. More countries and international bodies need to follow suit.

AfriForum’s mission is clear: Malema should not only be held accountable in South Africa but also worldwide.

We demand international repercussions for Malema.
